在美国如何把房产转给子女

在美国买房经常遇到这样的问题。买房时是不是要把子女的名字加上。是买时就加上还是还是买后再过户到子女名下。是有偿转让还是无偿转让。每个家庭的情况不同,目的不同,采取的措施也不相同。也就是说最终采取那种方式把房产转到子女名下要根据每个家庭的情况而制定具体方案。
1.只写子女的名字
买房时直接写子女名字,这样不牵涉遗产税和赠予税的问题。但18岁以下的未成年人无权签署法律文件,只能由父母或监护人代为办理,手续繁琐。通常需要房地产专业律师协助办理。当其子女将来出售房产时,可能需要付出庞大的资产增值税。如果是出租产业而不是自主居住,则全部的资产增值都要缴税。

2.同时写父母和子女的名字
产权持有方式有多种,选择不同的产权处理方式也将不同。以联合持有为例,房契同时写有母亲和女儿的名字,母亲去世后房产由女儿继承。比如,房产以200万美元买入,母亲和女儿各拥有一半产权(100万)。母亲和女儿的计税基数各为200万的一半,即100万。若干年后母亲去世,属于母亲的一半由女儿继承。假设当时市场价值已升为300万,继承部分的计税基数为母亲去世时价值的一半,即150万。再加上原先女儿受赠一半的计税基数100万,总计税基数为250万。如果以市场价300万出售,资产增值为300万-250万=50万。如果房子用作出租,50万的增值需要缴税。

3. 只写父母的名字
这种方式相对多见。购房时只写父母的名字然后过户给子女,也就是转让。转让分为有偿转让和无偿转让。
3.1.有偿转让
有偿转让和正常房屋买卖交易的过程相同。交易双方聘请经纪人,经有过户公司或律师办理。有偿转让的优点在于房产经过交易后子女就成了新的屋主,同时也获得了房主所有的权利。资产增值税将从转让交易完成之日开始计算。
如果采用这种转让,房子的价格不易过低。转让价格便有利的一面是少缴交易税。交易税是根据房产售出价格计算的。因此,房价低可以节省交易税。交易税是由卖家缴纳。
不利的一面是资产增值税。比如把一套价值300万的房产以30万的低价出售给其子女。如果这套房产是自己住,住够一定的时间后夫妇50万以下,未婚单身25万以下免增值税。增值超过免税的部分需要缴纳增值税。如果这套房产是用作投资房,卖房时资产的增值都要缴纳增值税。举个例子,若干年后子女把房子以430万美元出售,增值400万=430万(售出价)- 30万(当初购房的价格)。400万的增值是需要缴税的,增值税很高。如果按15%计算,400万×15%=60万。

3.2.无偿转让
赠予或传承是两种常见的无偿转让。赠予是父母生前将房产无偿转让给子女,传承是父母去世时将房产转让给子女(继承),也就是常说的遗产。赠予税和遗产税紧密相关。无偿转让的优点是费用低,没有交易税。
如果是贷款买的房子,贷款还清之前房子的所有权仍然属于银行。若银行同意是可以转让给子女的。值得注意的是所欠款项既跟着人走也跟着房子走。被赠予方只要卖房子还是要偿还欠款的,不然房产的产权就会遇到麻烦。
在2018年税改后赠予税与遗产税法规定美国公民或绿卡持有者的资产不论在那个国家全部会受到管制。每人终生总免赠予或遗产税为1120万美元,夫妻双方则为2240万的免税额。一般美国民众资产达不到这个数额,不用担心将来缴纳赠予或遗产税。外国人赠予税则只有6万的免税额。外国人在美国的有形资产如房地产是需要缴纳赠予税的。
值得一提的是康斗大都有物业管理,需要物业管理的同意。合作公寓购房者拥有的是大楼的股份。合作公寓的转让牵动到的是一整栋楼。所以在转让过程中通常要经过严格审核,包括合法身份,合格信用报告,工作型态,收入稳定度和家庭成员等。
房地产对很多家庭来说是最大的一笔财产,转让自然也就成了一件大事。具体怎样合理持有产权,怎样转让能够使自己的权益最大化,需要咨询专业会计师或房地产律师后制定出一个比较合理的方案。
